Terms and Conditions - Vacation Rental Agreement

1. Agreement Overview
This Rental Agreement ("Agreement") is entered into between Keith and Tatiana ("Owner," "We," "Us," or "Our") and the person making the reservation ("Guest," "You," or "Your") for the vacation rental property located in the North End neighborhood of Boise, Idaho ("Property").
By making a reservation, submitting payment, or occupying the Property, you accept and agree to be bound by all terms and conditions outlined in this Agreement.
If you do not agree to these terms, do not proceed with booking or occupying the Property.
2. Definitions
"Guest" refers to the person making the reservation and all individuals occupying the Property during the reservation period
"Property" refers to the vacation rental home located in North End Boise, Idaho
"Reservation" refers to the confirmed booking period
"Booking Platform" refers to third-party platforms such as Airbnb, Vrbo, or direct booking through our website
"Security Deposit" refers to the refundable deposit held to cover potential damages
3. Reservations and Booking
3.1 Booking Confirmation
A reservation is confirmed only upon:
Receipt of completed booking form (if applicable)
Payment of required deposit or full payment
Written confirmation from Owner via email or booking platform
3.2 Minimum Age Requirement
The primary Guest making the reservation must be at least 25 years of age. Valid government-issued photo identification may be required upon request.
3.3 Maximum Occupancy
Maximum occupancy is 8 guests. Exceeding this limit without prior written approval may result in immediate termination of the reservation without refund.
3.4 Accurate Information
Guest agrees to provide accurate information including:
Full legal name
Valid contact information (phone and email)
Number of guests
Purpose of stay
Any special requests or needs
Falsified reservations: Any reservation obtained under false pretenses will result in forfeiture of all deposits and payments, and immediate termination of occupancy rights.
4. Payment Terms
4.1 Payment Schedule
Full payment is due at time of booking, or as specified by the booking platform
Security deposit of $250 is charged at time of booking per Airbnb's deposit policy (or similar platform policy)
4.2 Accepted Payment Methods
Credit/debit cards (Visa, Mastercard, American Express, Discover)
Payment through authorized booking platforms
Other methods as agreed upon in writing
4.3 Fees and Charges
Guest is responsible for:
Nightly rental rate
Cleaning fee
Service fees (if applicable through booking platform)
Security deposit
Any applicable taxes
Additional charges for violations of house rules
5. Cancellation and Refund Policy
5.1 Cancellation by Guest
Cancellation policies vary by booking platform. For direct bookings:
30+ days before check-in: Full refund minus processing fees
14-29 days before check-in: 50% refund
Less than 14 days before check-in: No refund
No-shows: No refund
5.2 Cancellation by Owner
Owner reserves the right to cancel reservations due to:
Property damage requiring emergency repairs
Violation of booking terms
Acts of God, natural disasters, or government mandates
Other circumstances beyond Owner's control
In the event of Owner-initiated cancellation, Guest will receive a full refund of all payments made.
5.3 Force Majeure
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control including natural disasters, government actions, pandemics, utility failures, or other acts of God.
6. Check-In and Check-Out
6.1 Standard Times
Check-in: 4:00 PM
Check-out: 10:00 AM
Early check-in or late check-out may be available upon request and approval. Unauthorized late checkout may result in additional charges.
6.2 Access and Entry
Property features digital lock entry
Access code will be provided on day of check-in
Door automatically locks after 1 minute
Guest is responsible for securing the Property at all times
6.3 Owner Entry Rights
Owner reserves the right to enter the Property with 24 hours' notice except in case of emergency, which requires no notice.
7. Security Deposit
7.1 Deposit Amount
A security deposit of $250 is required and will be processed according to the booking platform's deposit policy.
7.2 Deposit Deductions
The security deposit may be used to cover:
Property damage beyond normal wear and tear
Missing or damaged items
Excessive cleaning required beyond standard checkout cleaning
Smoking or vaping violations
Unauthorized pets
Violation of house rules resulting in fines or fees
Unpaid utilities or services
7.3 Deposit Return
If no damages or violations occur, the security deposit will be returned per the booking platform's terms (typically within 7-14 days of checkout).
8. House Rules and Guest Responsibilities
8.1 Prohibited Activities
The following are strictly prohibited:
No smoking or vaping anywhere inside the Property (violation fee: $500)
No pets of any kind (violation fee: $500 plus cleaning costs)
No parties or events without prior written approval
No illegal activities including drug use
No open flames including candles on balconies or inside
No removal of furnishings from the Property
No subletting or assignment of the reservation
No commercial photography/videography without approval
8.2 Noise and Neighbor Respect
Quiet hours: 10:00 PM - 8:00 AM
Guest must respect neighbors and maintain reasonable noise levels
Violations may result in immediate termination without refund
8.3 Parking
Street parking only (no on-premise parking)
Guest responsible for observing all parking regulations
Owner not liable for parking tickets or towing
8.4 Property Care
Guest agrees to:
Leave Property in clean, neat, and tidy condition
Wash all dishes and remove all garbage to outside receptacles
Close all blinds/curtains before checkout
Report any damages or issues immediately
Use overhead stove fan when cooking
Not dismantle smoke detectors
Properly operate all appliances and systems
8.5 Bicycles
Four adult bikes provided for guest use
Bikes used at Guest's own risk
Guest responsible for locking bikes when not in use
Guest liable for loss or damage to bikes
9. Liability and Assumption of Risk
9.1 Hold Harmless
Guest, for themselves, their heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss, or damage which has occurred or may occur to Guest or any of Guest's invitees as a result of or in connection with occupancy of the Property.
9.2 Personal Property
Owner assumes no liability for:
Loss, damage, or theft of Guest's personal property
Injury to persons or personal property during stay
Inconveniences, damage, loss, or injury arising from temporary defects or stoppage of utilities (water, gas, electricity, internet, cable)
Weather conditions, natural disasters, or acts of God
9.3 Assumption of Risk
By booking and occupying the Property, Guest acknowledges and accepts full responsibility for any bumps, bruises, accidents, or illnesses that occur on the Property. Guest agrees to immediately report any observed safety hazards to Owner.
9.4 Stairs and Accessibility
Guest acknowledges that Property requires use of stairs and may not be suitable for guests with limited mobility.
10. Utilities and Services
10.1 Included Services
The following are included in rental rate:
Electricity, gas, water, sewer
High-speed internet (1G wifi)
Standard cable/streaming services
Weekly lawn service (typically Wednesdays)
10.2 Service Interruptions
No compensation will be provided for temporary outages of utilities or services. Owner will report outages immediately and make reasonable efforts to restore service as quickly as possible.
10.3 Lawn Service
All Pro Lawn Service performs weekly lawn maintenance (typically Wednesdays) and may enter the backyard without notice.
11. Damages and Maintenance
11.1 Guest Liability
Guest is liable for all damages to Property, furnishings, or equipment caused by Guest or Guest's invitees beyond normal wear and tear.
11.2 Damage Reporting
Guest must immediately report any damages, malfunctions, or maintenance issues to Owner at 208-890-4164.
11.3 Emergency Repairs
Owner reserves the right to enter Property without notice in case of emergency repairs or to prevent further damage.
12. Compliance with Laws
12.1 Legal Obligations
Guest agrees to:
Obey all federal, state, and local laws
Comply with all city ordinances and HOA rules (if applicable)
Comply with all fire, safety, and health regulations
12.2 Consequences of Violations
Failure to comply with laws or regulations may result in:
Immediate termination of reservation without refund
Forfeiture of all deposits and payments
Liability for any fines, penalties, or legal fees incurred by Owner
Legal action if necessary
13. Privacy and Data
Guest information is collected and used in accordance with our Privacy Policy. By booking, Guest consents to collection and use of personal information as outlined in our Privacy Policy.
14. Website Terms of Use
14.1 Intellectual Property
All content on our website including text, images, graphics, logos, and photographs is owned by Owner or licensed and protected by copyright, trademark, and other intellectual property laws.
14.2 Prohibited Use
You may not:
Republish, sell, rent, or sub-license material from our website
Reproduce, duplicate, or copy material without permission
Use content for commercial purposes without written consent
14.3 User-Generated Content
If you post reviews, comments, or other content:
You grant us non-exclusive license to use, reproduce, and edit your content
You warrant content does not infringe intellectual property rights
You warrant content is not defamatory, offensive, or unlawful
We reserve the right to remove inappropriate content
15. Modifications and Amendments
15.1 Right to Modify
Owner reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date.
15.2 Notice of Changes
Continued use of Property or website after changes constitutes acceptance of modified terms.
16. Dispute Resolution
16.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Idaho.
16.2 Venue
Any legal action arising from this Agreement shall be brought in the appropriate court in Ada County, Idaho.
16.3 Attorney's Fees
In any action concerning rights, duties, or liabilities under this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.
17. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
This Agreement, along with our Privacy Policy and any booking confirmation, constitutes the entire agreement between Owner and Guest and supersedes all prior agreements, representations, and understandings.

20. Acknowledgment
By completing a reservation, making payment, or occupying the Property, Guest acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
